Savannah, GA: From the early 2000s through 2015, the manufacturer of the U.S. Military’s standard-issue earplugs sold the services a product it knew was not effective. The manufacturer, 3M Company, settled the case brought by a whistleblower on behalf of the U.S. Government for over $9 million. However, that settlement does not compensate the potentially hundreds of thousands of personnel that used the defective devices, many of whom suffered permanent hearing loss as a result. A law firm comprised of former Marine Corps and Army servicemembers aims to change that.
“Military Justice Attorneys,” headquartered in Savannah, GA with offices across the country, are evaluating claims for serious hearing loss and tinnitus which is believed to be caused by the defective earplugs. Those have been identified as 3M Combat Arms Earplugs, version 2 (CAEv2). A common variant of this dual ended earplug was yellow on one side and olive on the other, and was standard issue between 2003 -2015. Military Justice Attorneys believes the earplugs suffered from a defective design that at times prevented adequate noise reduction, contrary to what the company previously represented to the government. They also believe that the company hid and falsified testing data on noise reduction tests. Servicemembers, veterans, contractors, and other personnel who suffered medically-diagnosed tinnitus or serious hearing loss can initiate a claim by completing a short electronic form at https://3mclaims.formstack.com/forms/3m_earplug_potential_claim
